Terms and conditions

These are the terms on which you use marsdenparkhomes.com.au (the "Site"), operated by Marsden Park Homes Pty Ltd (ABN TBC) ("we", "us", "our").

By using the Site you agree to these terms. If you don't agree, please don't use the Site.

There is a separate agreement that covers real-estate agents who pay for a listing subscription — see the agent terms.

1. What the Site is

The Site is an online directory of properties for sale, lease, or rent within postcode 2765 (Marsden Park, Melonba, New Park, Clydesdale, and adjacent estates). We are not the seller, lessor, agent, or representative of any property listed on the Site.

2. Listings are not our representations

All property listings are submitted by the listing agent. We:

  • Do not inspect the properties
  • Do not independently verify the information provided
  • Do not provide property, legal, financial, or investment advice

Before making any decision based on a listing, you should make your own enquiries and get independent professional advice.

We do our best to keep listings accurate and current, but we cannot guarantee that any listing is correct, complete, or still available.

3. Your account (buyers)

You don't need to create an account to browse listings. If you want to save a property alert, you may need to provide an email address — see the privacy policy for how we handle it.

If you do create or sign in to an account:

  • You're responsible for keeping your sign-in link secure.
  • You're responsible for all activity that happens under your account.
  • You agree to provide accurate information.

4. Acceptable use

You may use the Site for personal, non-commercial use to research property in 2765. You agree not to:

  • Scrape, harvest, or republish listing information without our written consent.
  • Use any robot, spider, or other automated means to access the Site, except for well-behaved search engine crawlers.
  • Submit false or misleading enquiries.
  • Impersonate any person.
  • Interfere with the Site's operation or attempt to access systems you are not authorised to access.
  • Use the Site for any unlawful purpose.

We may suspend or terminate your access for any breach of these terms.

5. Enquiries

When you send an enquiry, you understand and agree that:

  • Your name, email, phone (if provided), and message are forwarded to the listing agent.
  • The agent will reply directly to your email.
  • We may keep a record of the enquiry for fraud prevention and platform analytics — see the privacy policy.

6. Intellectual property

  • The Site itself — our logo, design system, code, written copy, and the overall presentation — is owned by us and protected by Australian copyright and trade-mark laws.
  • Listing content (photographs, floor plans, descriptions, videos) is owned by the listing agent or vendor and licensed to us for display on the Site. Don't copy or redistribute it.
  • You may link to listings and share them on social media, provided you don't modify them or strip the agent attribution.

7. Third-party links and embeds

The Site links to third-party services (YouTube for video tours, Mapbox for maps, agent websites, Stripe for billing). We are not responsible for the content of those third parties or for their privacy practices.

8. Disclaimers

To the maximum extent permitted by law:

  • The Site and its content are provided "as is" without warranties of any kind.
  • We do not warrant that the Site will be available without interruption, error-free, secure, or free from viruses.
  • We do not warrant the accuracy, completeness, or current relevance of any listing.

Nothing in these terms excludes any consumer guarantee, condition, or right you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, our liability to you (in contract, tort, equity, or otherwise) arising out of or in connection with your use of the Site is limited to AUD $100 in aggregate.

We are not liable to you for any indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of opportunity, loss of goodwill, or loss of data.

10. Indemnity

You agree to indemnify us against any loss, damage, claim, or expense (including reasonable legal costs) arising from:

  • Your breach of these terms.
  • Your misuse of the Site.
  • Any false or misleading information you submit.

11. Termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have breached these terms or used the Site for an unlawful purpose. The clauses that by their nature should survive termination (privacy, intellectual property, disclaimers, limitation of liability, indemnity) will survive.

12. Changes

We may update these terms from time to time. The current version is always at this URL with the "last updated" date below. Continued use of the Site after a change indicates acceptance of the updated terms. We will notify users of material changes via a banner on the homepage for at least 14 days.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute.
